Notice of Submittal of the Pinewood Site RCRA Part B Post-Closure Permit Application

This is to inform you that the Pinewood Site Custodial Trust (the “Trust” or “PSCT”) has submitted a Resource Conservation and Recovery Act (“RCRA”) Part B Post-Closure Permit Application to the South Carolina Department of Health and Environmental Control (“DHEC”) for the Pinewood Site (the “Site”).  The following is a brief background of the Site and description of activities at the Site.  

Description of Activities
The Pinewood Site, located in a rural section of Sumter County, operated as a hazardous waste landfill between 1978 and 2000. As part of the bankruptcy proceedings involving the Site’s last operator, Safety-Kleen (Pinewood), Inc. and DHEC reached a settlement with Safety-Kleen resolving Safety-Kleen’s long term environmental obligations to perform closure and post-closure care of the Site.  The PSCT was formed as a result of this settlement and was established for closure and post-closure care of the Site over a 102-year period, which began in 2003.  

In April 2003, Kestrel Horizons, LLC (“Kestrel”) was nominated by Safety-Kleen and approved by DHEC to serve as Trustee of the PSCT.  Under the management of Kestrel, the Site closure activities were executed in 2004, 2005, and 2006 under the oversight of DHEC.  Kestrel served as Trustee of the PSCT from 2003 until its resignation effective October 31, 2014.  Following Kestrel’s resignation, the Pinewood Interim Administrator, Inc. (“PIA”) became the interim administrator of the PSCT on November 1, 2014, and served in this capacity until September 13, 2016, when PIA was appointed by Sumter County Probate Court as the successor Trustee of the PSCT and later renamed the Pinewood Trustee, Inc. (“PTI”).

Since the closure of the final landfill section in 2006, the Site has been in post-closure care.  The RCRA Part B Post-Closure Permit Application that PSCT is submitting is required for the post-closure care at the Site.  Current post-closure activities include maintaining the closed landfill sections; performing environmental monitoring and treatment of groundwater; collecting, treating, and managing landfill leachate and leachate solids; managing off-site disposal of leachate and leachate derived waste; and permit compliance activities.  Prior to April 2013, all leachate generated at the Site was properly disposed of at approved off-site Hazardous Waste Treatment, Storage, and Disposal Facilities.  On April 22, 2013, the PSCT began treating the leachate on-site in the Leachate Treatment System.

Description of Comment Procedure
The South Carolina Hazardous Waste Management Regulations allow for at least 45 days for public comment on PSCT’s RCRA Part B Post-Closure Permit Application.  During the public comment period, any interested person may submit written comments on the permit application and may request a hearing.  A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing.  The comment period shall automatically be extended to the close of any public hearing held on the permit application.

The administrative record, which contains a hard copy of the permit application, will be kept at the Sumter County Library located at 111 N. Harvin Street, Sumter, South Carolina 29150 and will be open for inspection during the library’s operating hours.  All data submitted by PSCT in support of the permit application will be available as part of the administrative record.
